Detention-Free Policy for ISA

As reported in our Sept 28, 2007 Newsletter, here is the new policy:

U.S. Customs and Border Protection has posted a memo to its Web site outlining its revised detention practice for certain textile and apparel shipments from Importer Self-Assessment participating importers.

In the absence of deterring factors, CBP states it will no longer detain an ISA member’s imported textile and apparel goods during its request for and review of production records to determine country of origin subsequent to a Textile Production Verification Team visit to a foreign factory of concern.

(Deterring factors usually occur when the TPVT has identified that the manufacturer the ISA participant is using 1) has falsely declared a country of origin; 2) was closed at the time of the visit and was verified closed at the supposed time of production of the goods; or 3) never existed. Such a manufacturer is barred from this detention exemption.)
